Opposition Leader Hon Tuilaepa Sailele Malielegaoi has confirmed HRPP will be appealing the Friday 9 May 2025 decision of the Supreme Court ruling for the Speaker’s right to cast a deliberative vote in Parliament.
Chief Justice Satiu Simativa Perese in Malielegaoi & Anor v Speaker of the Legislative Assembly, ruled that the Speaker had a right to cast a deliberative vote during the third reading of the Constitutional Amendment Act 2025.
That Speaker’s vote tipped the scales — allowing the two-thirds requirement to amend the Constitution and reverse controversial bills passed in December 2020.
However in a Letter to the Editor by the Opposition Leader and former Prime Minister, Tuilaepa says they had anticipated the Court decision and had already prepared their appeal “in advance”.
Tuilaepa says they have a clear frame of mind, quoting, To Err is Human, To forgive Devine.
