Apia Samoa | Samoa’s human rights record was examined by the UN Human Rights Council’s Universal Periodic Review (UPR) Working Group for the third time on Tuesday, 2 November 2021, in a meeting that was webcasted live. The delegation of Samoa was headed by Hon Fiamē Naomi Mataʻafa, Prime Minister and Minister for Foreign Affairs and Trade.
Samoa was one of the 14 States reviewed by the UPR Working Group during the current session from 1 to 12 November 2021. Samoa’s first and second UPR reviews took place in May 2011 and May 2016, respectively.
These reviews are based on information provided by three reports. These are:
• Report by the State under review or Government of Samoa;
• Report from the independent human rights experts and groups (known as the Special Procedures), human rights treaty bodies, and other UN entities
• Summary of stakeholder submissions which included reports from national human rights institutions, regional organizations, civil society groups and other stakeholders
The UPR is a unique process that involves a periodic review of the human rights records of all 193 UN Member States. Since its first meeting in April 2008, all 193 UN member States have been reviewed twice within the first and second UPR cycles. During the third UPR cycle, States are again expected to declare what actions they have taken to implement recommendations posed during their previous reviews and highlight recent human rights developments in the country. The Government of Samoa’s current report focused on implementation of the 2016 recommendations, and maintained that ensuring the complementarity of our fa’asamoa and Christian values with human rights, is vital to our efforts for the promotion, respect of, protection and fulfillment of all human rights and fundamental freedoms in Samoa. This was one of the key messages of the Hon Prime Minister’s opening statement during the review.
Samoa reiterated the importance of assessing this process to allow for proper contextualisation of the issues.
During the review, 54 States made interventions to pose questions, make comments and/or make recommendations. In the outcomes report following review, a total of 145 recommendations were noted. The Universal Periodic Review (UPR) Working Group in Geneva adopted the outcomes report for Samoa on 9 November 2021, 2:30 p.m ( 10 November 2.30am Samoa time). The full report of Samoa’s review, including Samoa’s positions on the recommendations, will not be available until the end of November 2021. While the majority of the recommendations were ‘accepted’ based on the fact that Samoa is well on the way to complete the required actions, 31 have been ‘noted’ because full and considered discussions are ongoing on the issues involved.
Samoa is responsible for implementing accepted recommendations in the final outcomes report and will have the opportunity to again address the Human Rights Council UPR at the 4th Cycle tentatively scheduled for October – November 2026. As noted during the Hon Prime Minister’s closing remarks for the review “Samoa confirms the benefits and contributions of the UPR to our ongoing development and growth as a nation. The recommendations will form part of our human rights roadmap for the next 4 to 5 years”.
