A motion has been filed in the Supreme Court by the Attorney General regarding nomination and voter objection timeframes.
The motion was filed on Tuesday by AG Su’a Hellene Wallwork seeking further directions from the Supreme Court on the timeframes for court determination of nomination challenges and voter objections under advisement.
The OEC are receiving nominations this week, and the electoral roll is expected to be made available next week.
However, the Law allows for challenges to be filed against a candidate’s nomination. The Law also allows for objections to be made to a voter on the electoral roll. It is the timeframes for these challenges that the AG seeks clarification due the condensed timeframes imposed on the current electoral process.
Due to the condensed timeframes, clarification has been sought with the AG taking note that the current timeframes provided by law are extensive, however, the election date of 29 August 2025 will not allow for full compliance with timeframes set out in the Constitution.
The motion will allow the Courts to consider the time available and set clear guidelines to the timeframes that will guide each step of the process.
“The intention is to guarantee that the principles of a lawful and fair general election are not compromised.”
